Terms and Conditions – Moments by M&M

Effective Date: May 2025

These Terms and Conditions ("Agreement") govern the use of services provided by Moments by M&M LLC ("we", "us", or "our"). By booking our services, you ("Client") agree to the following terms:

1. Services Provided

Moments by M&M agrees to provide professional photo booth rental services as outlined in the Client’s selected package. Services include delivery, setup, operation (if applicable), and teardown of photo booth equipment.

2. Booking & Payment

- A 30% non-refundable deposit is required to secure the date.

- Final payment is due no later than 7 days prior to the event.

- Payments can be made via HoneyBook, Zelle, or other approved methods.

- If full payment is not received by the due date, Moments by M&M reserves the right to cancel the booking.

3. Cancellation Policy

- Deposits are non-refundable.

- Cancellations made at least 15 days before the event will not incur additional fees.

- Cancellations made within 14 days of the event will result in full payment due.

4. Rescheduling

- Rescheduling is subject to availability and must be requested at least 7 days in advance.

- Deposits will be transferred to the new date if rescheduled within 90 days of the original event.

5. Equipment & Venue Requirements

- Client is responsible for ensuring venue access, suitable space (minimum 8x8 ft), and power supply.

- Client agrees to cover repair or replacement costs for any damage caused by guests.

- If the booth cannot be set up due to venue restrictions or access issues, no refund will be issued.

6. Photo Usage & Privacy

- Moments by M&M may use event photos or videos for marketing and social media unless the Client opts out in writing before the event.

- Photos taken are shared only with the client and their guests.

7. Liability

- Moments by M&M is not responsible for injuries or accidents involving guests using the booth.

- In the event of equipment failure or unforeseen circumstances, our liability is limited to a refund not exceeding the amount paid.

8. Force Majeure

We are not liable for cancellations or delays due to events beyond our control (natural disasters, acts of God, illness, etc.). In such cases, rescheduling will be offered where possible.

9. Governing Law

This Agreement shall be governed by the laws of the State of Florida.
